Q: I was in a car accident in virginia, I am still under a doctors care the insurance company is pressuring to settle .

A: In Virginia, you have 2 years from the date of the accident to file suit. Insurance companies love to close files, especially if they can do so before the victim talks to a lawyer. They are very good at making you feel like you have to do things that you don't have to do, like giving a recorded statement (bad idea), signing a blanket medical records release (bad idea), and accepting a quick settlement (bad idea). You need to know the extent of your injuries before the case can even be properly evaluated. You should talk to a lawyer at your earliest convenience. I don't know of any personal injury lawyers who charge for an initial consultation. (I'm assuming you are talking about the other driver's insurance company. The answer is slightly different if it's your company because you have a contract with them.)

A: I agree with the advice of the other lawyer. As he said you a only have two (2) years to bring your claim. If you go past this limit, your claim is gone. You could be under a doctor's care even after two (2) years but you still must file a claim in court prior to the expiration of the two (2) year time limit. You should contact a Virginia attorney now such as myself.
