Norfolk, VA asked in Criminal Law for Virginia

Q: If I got into an altercation, he held me up against

The wall by my throat with my feet hanging 2 inches off the ground. When other mutual friends pulled him off of me, I reached for the closest thing to me, which was a wine glass, and swung the glass at him, striking his cheek. There was a cut on his cheek, and 3 of my fingers. He went to the hospital without insurance and is forcing me to pay him or sue me. I did not get my injuries assessed. I was slightly light-headed and felt still in danger. He was not being restrained tightly, but rather very loosely and was still shouting at me from within arms reach. It all happened within 5-6 seconds. Does he have any chance of winning a law suit against me for his cheek being cut, and requiring approx. 12 stitches?

A: I am sorry to say that nothing is ever certain when it comes to litigation. You may have a good case, but yes, he has a chance of winning. Seriously consider consulting a lawyer in person. A lawyer should be able to help you settle the matter once and for all.
