Q: Plaintiff's attorney will not file judgment satisfaction without $1400 overpayment. What is my recourse

A: I need more information to answer your question. Odds are, the $1400 in "overpayment" is for interest and court costs in bringing the suit against you. If so, the court will not consider this "overpayment." You are liable for these expenses. If these are not the expenses, then you should, in writing, demand that the attorney accept your payment and file a satisfaction of judgment. If he still refuses, you can bring suit. Make it clear to the attorney that you will continue to write until they agree to file the satisfaction. The attorney is not going to want to continue to spend money on this amount.

Satisfaction is also an affirmative defense against any further legal action taken against you by this creditor.
