Why Do I Owe Social Security For receiving A Workman's Comp Settlement When At The Time Of The Injury Iwas Only Getting V.A. Benefits And Nothing Else?
A: I practice WC law in Virginia so this is general information and not legal advice. If the WC settlement overlaps with the period of time you are receiving SS benefits, then the SS benefits are subject to reduction. In a WC settlement one can avoid this overlap by pro-rating the lump sum settlement over one's life expectancy but if this was not done then this is the cause of the reduction. That is why one should be sure one's WC attorney knows both WC law and SS law.
