Q: Do I need to transfer guardianship of my 17-year-old so to move in with an out-of-state uncle for school registration?

My son wants to move from Florida to his uncle in Virginia for his senior year of high school.

He turns 18 in September, but is still a minor when registering for school in August this year.

A: Probably not, but it depends upon whether the school in VA will require a court order. If so, you could file a petition for temporary custody by extended family and get a court order that the uncle has temporary custody. The filing fee is $400, and a reasonable attorneys fee in my area would be $750 and up. In order to avoid this expense of over $1000, he could wait until he turns 18 and then register. That would be the most cost efficient way, to stay in school here until the right time to register in VA. There is one other option.
