Q: Can I disqualify a judge for bias once trial starts. (civil. Superior Court Ca.)

A: In some cases there are certain procedures to disqualify a judge at the outset of a case on the basis that any party can pay a fee and disqualify the judge or on the basis that the judge has an actual bias or conflict of interest. Once the judge issues his or her first ruling, and that has happened once a trial starts, there is no procedure for disqualification. The only remedy then is an appeal and for that to work the bias is going to have to be pretty obvious on the record.
