High Point, NC asked in Elder Law for Florida

Q: Can the Dept. of Revenue for the state of Florida "double dip" my social security benefits?

I am 69 years old. A woman, not my wife, had a child by me 12 years ago. I receive $660.00 per month in social security. The child receive $186.00 a month from my social security for the past two years. The years before my retirement I paid $760.00 per month. The Dept. of Revenue has requested from the SS folks to withhold $760.00 from the $660.00 I receive. The SS Admin. only allowed $245.00 from my $660.00 to be taken every month. Adding the $187.00 the child already was receiving as a dependent the total is $432.00 per month out of my current social security. my question is...Is that legal?
