Q: if my lawyer submits a claim and does not get a rejection from the company we are suing, do i have a good case

A: The fact that the claim was not rejected has no bearing on whether you have a good case. However, since you are represented by a lawyer, you should definitely discuss this question with your lawyer.

A: Insurance companies love to collect information on potential claims against them. You collect information by being an attentive, empathetic listener, or, if dealing with an attorney, by being polite and appearing interested. As long as the insurance company is in information collection mode it will not defeat itself by rejecting the claim. If the insurance company is going to reject the claim they will do that when they have finished collecting information.

A: People are desperate to know if they "have a good case." Sometimes, they ask their lawyer a similar question over and over and then come to boards like this trying to find a deeper answer. But they are not going to find one.

Charles Synderman is right. Ultimately, you have to sit down with your lawyer and get information you need. And even then you might not be satisfied because it might be unknowable.
