Q: I have no legal court order of custody how do i get my kids back
I recently left my kids father i agreed to let him have them for the weekend and he signed a paper saying he will return them on Sunday before 7 pm and here it is Monday and i have not heard from him we have no court order for custody is there anything i can do to get them back before i file a court order that i plan to file as soon as the courts open can I go there with the police and get them?
A: The police will only do a welfare check with the facts that you presented. If the children are fine, they will not remove them from the father. You would do well to schedule a consultation with an attorney ASAP and file for custody ASAP
A: I should add, that if the children are school aged and he is not taking them to school, then you may be able to get in front of a judge sooner rather than later.
