Q: what would be my husband current USCIS status? I am a US citizen, did a I-130 and had approval notice.
I am filing the rest of papers, such as I-485 and one of the questions is current status.
Thank you!
A: More facts are needed to answer your question. Where is you husband here or abroad? How did he last enter the U.S.? Does he have a current visa? I strongly encourage you to use an attorney to do these forms. Simple mistakes, which are easy to make, can cause huge problems. If your husband is here in the US under a current visa and entered legally, he should be in status for whatever visa that is and the I-485 Adjustment of Status is the right--well one of the right--forms to be filing. If this is the case, you should also look into the following forms: I-864, Affidavit of Support, I-693, Medical Exam Results, I-765, Application for Employment Eligibility and the I-131, Application for Advance Parole. Keep in mind that he cannot leave the country before his green card is issued unless he has been approved for advance parole. If he is abroad, or if he entered illegally, he likely needs to go through immigrant visa processing.
