Q: I was divorced in FL in 2013. I got custody of our son. My ex lives in Georgia, I in MD. She's no longer working and is

Getting payments from social security disability. How do I go about changing the child support order so she no longer has to pay? Our son is getting social security payments also.

A: In Maryland, social security disability is still considered income when determining child support. However, if you are agree to terminate or modify the child support amount, your ex needs to file a Motion to terminate or modify custody. She should start by talking to a Florida attorney and even perhaps a Maryland one, those are the two states that can have jurisdiction over the child and therefore the parties for purposes of child support. Since no one lives in Florida anymore it should be easy to have it heard hear in Maryland. Again this is something she should do.
