Q: My deceased mother owes state taxes. She has no estate or beneficiary I shouldn't be reliable for her owed tax

I was wondering if the state ca would eat it. Or if they would somehow try to come after me or brother. Like i said she has no estate.

I am sorry for your loss. Generally, your mother's estate would be liable for her liabilities, so the state tax collectors can go after her estate's assets, if any. If you or your brother received a part of her estate before the liabilities were paid off, in that case the tax collectors may pursue you for collection. Be sure to consult your own attorney to protect your legal rights.

A: Only your mother’s estate at the time of her death would be liable for her debt. They could come after one who may have misappropriated her estate.
