Pflugerville, TX asked in Child Custody for Florida

Q: My daughter recently fled Florida due to domestic violence which included her husband theatening to kill himself

He discharged a firearm in the home with her and the two children present. She came to Texas due to her fear of him. He has filed for divorce demanding return of the children to Florida. We are afraid for the safety of her and the children. He is very controlling. If she has to return to Florida, can she move and the children move into a shelter for protection. He is an alcoholic and sells drugs. Can grandparents intervene and take custody to protect the children. They have witnessed the domestic issues. The mother is afraid he will shoot her or the children due to his anger issues. Police have been called to the residence on two occasions by myself and another parent for welfare checks due to his anger. My daughter is willing to get any help possible for herself and the kids. He doesn't make enough money to support himself much less the kids. Hewithheld money from her, tried to take her car keys, and took away her phone. He has not worked steady for 15 years and she has.

A: If the children lived in FL then you have to deal with the case in FL. You can ask for emergency custody and child support.

Use of a lawyer is recommended.
