Q: Can I sue for replacement cost of an irreparable computer?
I had filed suit in small claims for repair to computer keyboard and punitive damages. The case was dismissed (by Judge Judy who never heard the facts). I have since learned that a portion of the damage to the case is irreparable and would now like to sue for the cost of the entire computer. Are these two different issues and can I sue again for the same product but different circumstances?
A: Well, was the first suit dismissed with or without prejudice? The order should say. If it was dismissed without prejudice, that means that you can bring another suit. Since you represented yourself, you did not know that you might have been able to amend the complaint. In addition, I do not even know who your are suing, the manufacturer or a repair shop might be who you are suing, but you did not say much in your question.
A: Maybe. It depends... you should call a lawyer and go over all of the facts. That said- my guess is that the terms of the arbitration you were involved in would bar you from reopening the case.
