Glastonbury, CT asked in Immigration Law for Connecticut

Q: Intent of denial notice on my I 485 stating unlawful status of L1A...

Hi,

USCIS has issued NOID on my I 485. I was transferred from my foreign parent company to US subsidiary in 2010 on L1A visa approved on the subsidiary. Due to restructuring, I was transferred to a US branch of the parent company for a year, and transferred back to the subsidiary. USCIS has raised objection to it citing INA 245 stating that my transfer from US subsidiary to US branch was violation of L1A status. The US subsidiary is fully owned by the Parent company, of which the US branch is an office. Since my transfer was to an affiliate company within the same group of companies, is this really violation of status? I was never transferred to any "outside" company. I will appreciate your response. This NOID is giving me nightmares.

Thanks and regards,

Sam
