Q: I came with my mother to usa when I was 6.my mother had a f1 visa and I had a f2 visa. We overstayed our visa date.
We overstayed our visa date by 10 years. And I was 16 when we wanted to return back to our country and left USA. Now 20 I want to know if I can return to usa or if I'm banned to ever return.
I was thinking I can go to us because I was a minor when I left USA. Need some help
A: First, the "visa" expiration date does not matter; how much longer did you remain after your I-94 expired? If more than one year, then you are subject to the 10-year bar. Unlawful presence is not counted for the time you were under 18 years old. However, if you remained outside the US for more than 10 years, then you can apply for re-entry. On what basis do you want to return to the US (as a nonimmigrant)?
