Q: I would like my former employer not to enforce a non compete agreement I signed. Will this be possible?
The company I worked for is based in FLL. They are a concession on board luxury cruise ships.
They can no longer offer me employment due to unavailibility of ships. I was not fired nor did I leave on bad grounds. If circumstances allowed, I would still be working for them.
I have been approached by another company that would like to hire me but they are concerned about my non-compete agreement(NCA)and do not want to take the risk of litigation. The company that is interested in hiring me would like me to produce a legitimate release letter first before hiring me.
I have enquired about the possibility of my NCA being waivered so that I can move on with my career. However I have been told that they are not willing to waiver it.Please help.
A: Take the non compete agreement to a local attorney for advice about this. Then there can be a full discussion. NCAs are limited in scope and duration, and you cannot get answers about your specific agreement without providing a copy for an attorney to read. An attorney might be able to write a letter for you or represent you in the event suit is filed against you. There are usually defenses to these types of suits, but you have not provided anywhere near enough facts for a meaningful answer.
