Q: On WC for over a year for hand injury. Now scheduled for FCE.When will checks stop if results show ability to work?

A: If the carrier has scheduled the FCE, you have the option of fighting the FCE as going beyond the examination permitted by the Pennsylvania Workers' Compensation Act. Assuming you attend the FCE, the FCE alone will not stop your checks. The employer must take further action either in the form of filing a petition and obtaining a decision from a judge or convincing you to sign a document agreeing to have your wage loss benefits suspended. Obviously you should not sign anything without reviewing it with an attorney. If you do not already have an attorney, you should seriously consider obtaining one at this time.
