Q: I was sued for $1900.00 today because a customer bought hardwood flooring from us and then was unhappy,
I offered a full refund or exchange flooring for better quality and customer refused and had flooring installed then sued me 1900.00 for waste , the judge ask customer why they installed flooring when dissatisfied ? they said it had to be done now , in my opinion the judge was confused , and ruled the wrong way, we are asked to pay for what the customer considers waste 60 % !!
The customer ordered rustic flooring which is usually pretty rough and has lots of character, I am not happy with the outcome of course.
We went in great detail about rustic , cabin grade , character flooring explaining to him that he may want to order something of a little better quality, he paid only $1.32 per sq ft then sued us, We sold Millions of sq ft of hardwood floors,
I was in the flooring business for over 16 years and never had this problem before , I am looking for an honest 2nd opinion. Thank You
A: First things first, a magistrate likely heard this case in small claims court. If you wish to object to the magistrates decision, you only have 10 days. Second, no lawyer can offer you a good opinion on the case based on the few sentences here. Was there a written contract? If so, what were its terms? If not, what were the terms of the oral contract? Did the customer make speed an issue when negotiating. Did he or she view sample flooring and assent to it? What is the nature of the property in which the flooring was installed? What condition is the property in? What is used for? Etc. Etc. Etc.
