Q: How much is an ankle/ foot work related injury worth? I have been off work since 1/24/14.
I broken my fibula and dislocated ankle at work on 1/24/14. I had several surgeries since. I still have pain around my ankle on my right foot. I am not cleared to return to work, but at my last doctors appointment, an independent case manager sat in on my evaluation. She convinced the doctor to write my works restrictions are as previous " which is light duty". my company nor insurance company can give me a job description or salary for this light position. They have stop my benefits. Also, I went to an IME and the doctor performed a nerve block. I never filled out any consent forms. Did he violate my right as an IME patient? Can this be a criminal offense towards the doctor?
A: You need to consult a workers' compensation attorney immediately. There are a number of rights that the insurance company may be violating. As for the value of the case, an attorney will need to send you to a doctor for another ime. THis should not be set up by the insurance company. The ime which is performed will determine the true value of the case. Also your wages, job status, and future treatment will all play a value of the case. It is not a good idea to settle until atleast discussing with an attorney.
