Palm Beach Gardens, FL asked in Criminal Law for Florida

Q: Can I recant a statement I verbally made to the police? I was coerced into saying something because I was scared.

I also obtained the discovery and most of my statement was also made false by the police. I wasn't charged with anything, but don't want anyone to get in trouble for something they didn't do. This is a drug case.

A: The answer is no in my opinion. The defense attorneys should be made aware of this problem and will make decisions on how to deal with it. This is much more complicated than you realize, and you should perhaps go see a criminal defense attorney yourself. You have not told us what was said or what is in the police report. This is how the prosecutors and cops win cases, by stacking inferences and obtaining facts that are not actually true.

A: Probably not. Simply being scarred isn't a valid excuse. Most people when arrest are scarred. You should consult a criminal defense attorney as soon as possible.
