Fort Lauderdale, FL asked in Animal / Dog Law for Florida

Q: What can I do to stop my neighbor from reaching into my yard to pet my dog?

She broke into our backyard countless times while the family was at work&school in the morning to be with my dog. When caught and told to stop, she wrote a letter apologizing (we have the letter still). She has not stopped reaching into our yard to feed our dog treats and petting him. What can I do to make her stop?

A: Hiring an attorney to sue for something like this is unfortunately going to cost many thousands of dollars in my opinion, and there may not be any relief available to you. My suggestion is to recognize that this is actually your neighbor, and make friends with her, but let her know that giving the dog treats and petting the dog is going too far.

A: I would suggest having an attorney send a cease and desist letter. I would also put additional locks or fencing up. Since you know that she is doing that you, without proactive steps on your part, you may have some liability if the dog ever bites her.
