Q: I know that I need a building permit. But am I considered a contractor within Pennsylvania Workers Compensation Law?
I need to know if I am considered a contractor within Pennsylvania Workers Compensation Law or not. The cost of the permit is based on square footage, cost of material and weather or not I am considered a contractor or not. If I am NOT considered a contractor within the Pennsylvania Workers Compensation Law, the cost of the permit is less and I won't be required to purchase Workers Compensation Insurance. If either my son, my wife or I would be injured we would be covered by our homeowners insurance and our personal health insurance.. Worker Compensation Insurance is very expensive and I would not have the extra funds until spring of 2016. We have already demoed the previous deck/porch because they were unsafe, the porch roof is still intact and in good condition. The sooner we can get the porch and deck replaced we would be able to avoid the colder winter weather and be able to enter the home safely.
A: This question requires much more information to answer and involves several laws other than the Pennsylvania Workers' Compensation Act. I would suggest that you schedule an appointment with a local lawyer familiar with both workers' compensation and the other laws surrounding construction matters to obtain a competent opinion.
