Q: What is the timeframe under WC that you are forced back to work?
Had back surgery and given deadline to return to work because of my medical insurance before full recovery.
A:
There are two separate questions here. As to the question actually asked, there is no time frame that you are required to return to work under Pennsylvania workers' compensation. Each case is treated individually based upon the nature of the injury and physical abilities of the injured worker as well as the physical demands of the job.
As to medical insurance through your employer, this is separate and distinct from your work injury. Pennsylvania workers' compensation does not provide any form of job security or preservation of employee benefits. Therefore, you may be required to return to work to preserve your employment or entitlement to medical insurance through your employer, but a failure to return to work does not mean that your workers' compensation wage loss or medical benefits will end.
