Q: How much of my husband's pension do I receive if I have been married 22 years.
Been married for 22 years. Husband is ready to retire in 2018. His pension is at about 400000 right now he wants a divorce situation is his pension doesnt fully mature until 2018 and it will mature at one million dolllars. Do I get half of his whole pension or half of the length of the marriage which would leave me at 200000 or so?? The argument is why would I get penalized while his pension continues to mature and increase????
A: Without knowing more facts, you are entitled to your equitable share of his pension that was accrued during only the time you were married.
