Q: Can a parent wave support if they both agree?
My son and his girlfriend have a daughter. They stay at his (our) house 4 Nights a week he pays for all of his daughters needs except his girlfriend has his daughter on Government health insurance. There is no Custody papers. He's a good dad who supports his Daughter. What are his options on Child support?
A: If the granddaughter is on Medicaid, and the couple splits, the Child Support Enforcement Agency (CSEA) may file for your son to pay child support. If they are still together and making it work, there is likely no reason to get the court or CSEA involved. If he ever went to court for a child custody order, then child support is likely to be ordered, as well.
