Q: F1 OPT to H1B or J1 transfer during OPT 60 days grace period
My F1 OPT expire on December 31, 2015. I'm planning to submit my change of status application to J1 or H1B by the February 2016, with my joining date July or August 2016. Do you think this is fine to keep my status valid or there are some problems in joining date. I mean the gap between joining date and OPT expiry is too long?
A:
Okay few things you have to understand in this situation, as soon as your OPT expires you will be out of status. A change of status means you are changing from one status to another but in this situation after december you will be having no status to change from. You have waited too far to submit as of now, contact an immigration attorney as soon as you possibly can do get this process started soon. All the best.
