Alexandria, VA asked in Contracts for Virginia

Q: We signed a contract with a web designer in Romania We would like to cancel our contact. Can we recover our money?

We would like to cancel the contract due to nondelivery of agreed deliverables and unwillingness of designer to submit an acceptable affirmative action plan. Also lack of communication was a big problem.

Here is what our contact says

Any disputes arise from this contract will be litigated in Romania.

If we terminate the contract it says we will pay a kill few of 30% of the project.

We agreed to pay $4,000 and we paid 50% up front. He is still demanding 30% of the remaining balance! We haven't received anything and it's been 1 month. If anything we need to pay 30% of the project which would be $1,200. We don't even want to pay that as he has done nothing

Thank you so much for your time and help!
