Q: In a Bifurcated cases where the underlying can be proven by, evidence, and the firm that let them get away.
That filed in court and dismissed it thinking it was frivolous. Is there a case there. And why is it so hard to get legal help. I was a victim of medical malpractice and medical negligence where a neurosurgeon left me with rubral tremors after he told me the problems that I was having pain and swelling in my legs and feet was coming from a chiari malformation type 1. He said if I had this surgery I will be 85% better. It failed and I was left with rubral tremors and deep brain stimulator because of trusting him. I also trusted that the law firm that asked to represent me against all involved I sent them overwhelming evidence that I never had tremors before my surgery and it was Ignored. They did nothing to help me as a victim and let the criminals get off. Also withheld a lot of important information from me. Is that a law suit? And would they be considered negligence?
A: Unsure exactly what happened. If you went to trial, the other firm would have spent money and only be paid if they got you money so they have an interest to try the case. Understand that proving that the doctor did something wrong and it was that that caused your problems is difficult. In your case it sounds like the surgery did cause the problems but the question is did the surgeon do something wrong. Not clear as you think that he did. But why not contact a lawfirm that handles both legal and medical malpractice and review these complicated questions with them.
