Q: How to demonstrate domicile in the united states for a permanent resident applying for immigration of his son?
My father is a 71 year old retired medical officer from India with a green card. He has 3 children. One son and one daughter that are citizens of the united states and one son who is still studying in college in his early 20s in india. Given that his youngest son is not well settled yet, he has to spend majority of his time in India. He does make trips every six months to the US to keep his permanent residency. He applied for a 2 year extension of stay which was granted and is currently in India with that. He applied for a green card for his youngest son before the son turned 21. His oldes son and daughter in law are financially supporting the application for the immigration of his youngest son although he is the primary petitioner. The application has been put in pending status because they want him to provide proof of his domicile in US. He does not file taxes in the US because he earns no income here and he primarily resides in India currently because of youngest son.
A: You're going to want to gather any and all papers, documents, bills - anything - that ties his name to whatever his address may be in the US. Caution, however - it's possible to abandon permanent residence in certain situations if out of the country for too long. Your father should consult with a US immigration attorney to get all the facts and 1) help answer the request for proof and 2) make sure and take steps to ensure that he doesn't lose his own residence.
