Houston, TX asked in Divorce and Immigration Law for Texas

Q: I got my wife here from the Philippines. Will immigration put me in jail if I leave my wife?

My wife is from the Philippines and she has became a living nightmare. we get into fights all the time and I even called her cheating on me. she called the cops on me two years ago and had me in jail facing felony charges for domestic violence. I had to go through 18 weeks of domestic violence counseling on my case was dismissed under pretrial avoided. If my wife wouldn't have written a certified letter pleading with the court admitting that she was the aggressor in fight and not to put me in jail, I want to have to do two years in prison. But she still wants to carry on with the same attitude that is out of control. when I get counseling, My instructor inform me that if your girlfriend a spouse does not helping you control your anger and they are the aggressive. You need to leave (separation/divorce) with no exceptions. but she keeps leading me on to thinking that she's going to change. but just yesterday we had an argument and she through her own car into park while I was driving.

A: I don't see why immigration would put you in Jail if your spouse is the immigrant and not you and definitely don't see why Immigration would do that if she is the aggressor. To better understand and clearly answer your question, contact an immigration attorney such as myself and obtain a thorough advice. You may also need to contact a divorce attorney in your state on the separation/divorce part of your question.
