Q: I need to file a modification of custody and Contempt of a court order, how do I obtain the correct paper work to file.
I don't have the money to hire a lawyer I have already been to court and have a custody order in place but since the custody order I have changed jobs I have joint custody but only get my kids every weekend except for one and every other week in the summer I want to be able to have more time with them my ex husband and children's father lives with his mother and she has blocked me from calling their phone for the past 5 years it has been mentioned in court and on the custody agreement it says that we should have daily phone calls with the children and I'm not able to talk to them everyday either because my kid's father has left them with his mother and does not want me to know that he spends a lot of time away from the children I have a developmentally delayed son that is 9 years old and expresses that he wants to live with me because there is fighting in the home and a My16 year old has spent most of his time at the neighbors house. I have had to call DSS and have serveral checks

Here is the form to file a motion to modify custody: http://www.nccourts.org/Forms/Documents/293.pdf
There are no forms for contempt. You have to create that paperwork yourself. Representing yourself in a custody case means that you need to educate yourself regarding what paperwork needs to be filed, what allegations that paperwork must include for a modification or contempt, how to serve it, how to schedule a hearing, the rules of evidence, i.e. what evidence needs and can be presented in court (and what can't), what witnesses to bring and how to question them. If you can't afford an attorney to represent you in court, at least hire an attorney for litigation assistance to walk you through the process and try to help you make sure that you do not end up worse off than you are now.
