Q: do i have a legit reason to dismiss counsel, after 5 months have passed since family member was killed by a truck ,

5 months have passed since family member was killed by a truck as he crossed within unmarked crosswalk,accident was on security video, it shows it was well lit, pedestrian walked across 5 lane street was hit as he was approx. a few feet from reaching the corner, to date we counsel has not mentioned negotiations or lawsuits. he states after 5 months he will examine truck that killed pedestrian and based on his findings he will hold a mock trial.

A: You provided some but not all of the fact surrounding legal representation. You should set up an office meeting with the attorney to find out the work done to date and the work to be expected to be done in the future. It is a good sign that the attorney is conducting a mock trial. Good luck with the case. I am sorry for the loss of your family member.

A: In some states, the probate process has to start and that can take a few months to have a personal representative appointed to be able to negotiate a settlement. Five months is generally not that long for personal injury cases.
