Norfolk, VA asked in Workers' Compensation for Virginia

Q: Is there an expiration on how long you can get workers compensation from your employer

My workman's compensation is telling me that my 500 weeks are up and then I need to find an alternative as far as payment is concerned especially since I still have the problem that I have been diagnosed with.

A: The limit for wage benefits is 500 weeks, except for certain types of catastrophic injuries. Your question does not provide sufficient information to determine if you qualify. Consult an attorney near you for additional advice about your available options, such as social security disability benefits.

A: If your 500 weeks are up, then this is probably the end of the compensation part of your claim. However, you should have lifetime medical coverage for your claim. You should also check to see if you have received all of the cost of living adjustments you are owed.

If you have trouble walking due to your injury or if you have trouble using both arms due to your injury or if you have a brain injury due to your injury, you should have your case reviewed by an experienced workers compensation lawyer.
