San Jose, CA asked in Personal Injury and Insurance Bad Faith for Mississippi

Q: Do I need a lawyer

I recently filed a claim with my insurance which was reinstated on the same day as the accident involving an 18 wheeler. My claim was denied and my insurance was cancelled. Once I went to get a rental I found out that progressive said my policy was cancelled on the 27th and the accident happened on the 29th. They sent an email stating it was reinstated now on the 2nd of April they said my policy was cancelled on the 27th and there is nothing I can do. What should I do?

A: You may not have insurance as of the date of the crash. Your insurance company is taking the position that you did not have any coverage. This, in turn, will save the insurance company the money it would have paid out on the claim. When insurance is cancelled, there are certain notice provisions that are controlled by state laws and the policy itself. Contact a local personal injury or insurance attorney for further advice and guidance on this matter. Good luck.
