Q: I want to marry my girlfriend and move to the US with her, but I don't want to violate my tourist visa.
My girlfriend lives in Missouri - Poplar Bluff. I'm from Denmark.
We've known each other for years and despite having only met in person once in those years, we've ended up in a relationship that reached it's height when I came to the USA on a Visa Waiver.
We've decided that we want to together and to get married.
I suppose that technically makes us engaged.
We understand that we can already file for a fiance visa now, and then when I get home, I can use the fiance visa to return and we can get married.
But is this necessary? It seems like a ridiculous courtship procedure.
We'd like to speak with an immigration lawyer in/near Poplar Bluff, but haven't had any luck contacting one. They simply don't call or write back.
We've been told that if we get married while I'm here as a tourist, it will be seen as a violation of my Visa, and this can get me banned from the country as a fraudulent act.
I intend to join the US military to get a citizenship.
A: You have several options, but those are best discussed in a consultation with an immigration attorney and not on a public forum. If you intended to depart when you entered on your tourist visa, you did not commit fraud or misrepresentation even if you change your mind. I am in St. Louis if you'd like to discuss further. I apologize I don't know of any immigration attorneys in Poplar Bluff! Good luck with your case!
