Q: I was served with a Summons and Complaint.

The claim is that a shopping cart under my control caused damage to a motor vehicle. The operator of the motor vehicle hit my shopping cart while I was crossing the roadway with the shopping cart within a clearly marked crosswalk. It says that I have to file a Notice of Appearance and Answer with the Plaintiff's attorney and file copies with the Clerk of the Court. My question is where can I get I get the forms and how do I show proof of service to the Plaintiff's attorney? The trial is to be held in Suffolk County NY. at a date in the future. Do the court and the attorney both get copies of the two forms? My only income is from Social Security thus I cannot afford to hire an attorney. Thank you for any assistance you can provide! My location is Suffolk County NY and NOT Scarsdale NY as the location is being displayed!

A: If you have renter's or homeowner's insurance, that is liability insurance and you should send the complaint to them ASAP.

A: You need to immediately get the Summons & Complaint to your insurance carrier. If you do not have insurance you need to hire an attorney to answer the complaint immediately.
