Winter Garden, FL asked in Animal / Dog Law for Florida

Q: Man who adopted a dog from us contacted us months later saying he is aggressive and bit wife and friend They want to sue

I bought a dog from a lady who originally got him from a shelter. My dog did't like him so we adopted him out to a couple who months later contacted me saying he is aggressive and bit the wife and neighbor. They claim they put him through training class with "no result". This dog NEVER showed any signs of aggression to any of us, NOR did he bite any of us, or our dog. The woman we bought him from gave us his paperwork from the shelter with current vaccines including Rabies and his neuter statement. We in turn gave this paperwork to the couple who adopted him from us. The lady we bought him from never said anything about him being a biter, and we never experienced him biting us or anyone while we had him. This couple we adopted the dog out to now months later is saying he is "highly aggressive" and want their money back or will sue me. How can they sue me if their dog bit the wife and neighbor? Seems like they just want the $300. They dumped the dog at the pound in their city.

A: Threatening to sue and actually suing are two different things. It doesn't appear that they have a case. They want the $300 they paid you? That wouldn't be the proper measure of damages even if they did have a case; it would be the medical bills, pain and suffering, etc. It doesn't appear that they have significant damages.
