Q: What is the penalty of failure to carry green card.

I was given a ticket, and will be going to court in VA. He told me I violated a federal law

A: The Immigration & Nationality Act says at section 264e:

"Every alien, eighteen years of age and over, shall at all times carry with him and have in his personal possession any certificate of alien registration or alien registration receipt card issued to him pursuant to subsection (d). Any alien who fails to comply with the provisions of this subsection shall be guilty of a misdemeanor and shall upon conviction for each offense be fined not to exceed $100 or be imprisoned not more than thirty days, or both."

I am surprised you received this ticket or charge without it being part of a bigger problem. Perhaps you were given a traffic ticket and the officer mentioned the green card problem as well. You may want to consult with an immigration attorney who also does traffic tickets (if this is a traffic offense) to review the documents and help you plan accordingly.

If you have lost your green card, you can request a new one using Form I-90, available at uscis.gov (fees will likely apply). You can also schedule an Infopass appointment at your nearest USCIS office to get a stamp in your foreign passport as other evidence of LPR status. Good luck!
