Q: Wondering If i can take someone to civil trial?
Here is the situation. Went to the bar one night. Saw a friend there and they called me over. Start having regular bar talk. The conversation came to how to best remove ear wax. The friend that called me over started waving their hands around in a non violent manner. Well the friend they were with started making fun of them and I also started making fun of of them. To back track just a bit I have an abdominal hernia. Its been brought up many times before including that night. After I started teasing them non violently they decided to punch me in the hernia. No warning just a straight punch. Needless to say that was very painful and I ended up calling my surgeon. My surgeon says to monitor and if it gets worse to go the hospital. The hospital says to that I will have some swelling in that area and will be highly uncomfortable. My surgeon who I initially called about the incident contacted me and asked me to come in and they felt like the hospital diagnosis was correct and will be extrem
A: you have a case for assault & battery. Hopefully you will be well. Unless the alleged friend has money I don't see any insurance coverage that would make it worth anyone's time to sue him--all they'd get would be a piece of paper they'd be unlikely to collect on.
