Rochester, NY asked in Personal Injury, Civil Litigation and Education Law for New York

Q: Can I sue my old school and/or football coach for harmful behavior that causes me psychological damage to this day?

Throughout high school, I had a football coach/teacher who committed a wide variety of disturbing and cruel acts. I need much more than 1,000 characters to describe them all, but here is a brief overview: I have a speech impediment (stutter), and he would specifically pick me out of the bunch to do our pre-practice cheer/chant in hopes I would stutter in front of the team. He threw balls at kids' heads, and one time even ordered another player on the team to "take me out" in practice because I was breaking up a play he designed. Ever since that specific hit, I have felt slower when processing thoughts. He did not ask if I was OK, but laughed and told the kid "good job." He threatened us with extremely vulgar language. One of his most infamous threats was, "I will rip off your heads and s**t down your throats." One time on his duty as lunch monitor, blatantly high on marijuana or some drug, he walked over, tore my friend's school folder in half and walked away without speaking a word.

A: Sounds like a nasty piece of work. However, generally can't sue after the statute of limitations. You have until your 21st birthday (3 years after your 18th). So if you are 18-20 yes, if you are 21 and up doesn't look like it--but why not get a free consult from a member of the NYState Trial Lawyers Assn?
