Alexandria, VA asked in Criminal Law and Car Accidents for Virginia

Q: How long does a hit and run investigation take? The criminal was found and refused to comply.

My car was hit and the criminal fled the scene of the accident. The car no longer works because the whole back got destroyed. A neighbor saw the man speed away and notified me about his location. The criminal admitted that he caused the accident to my mom and exhibited signs of intoxication. Once the police arrived he went into his home and turned off all lights. The police had a warrant for his arrest, but they never arrested him because he never came out of the house. The car was used for work and I've missed some days because of lack of transportation. It's been a week now and I have still not heard from the police. I can't even get a rental car because I need the other person's policy number.

A: Follow up with the police. They can at least work it like a crash. If you have collision use that--they can hassle over it. You can make a claim with his insurance if the police get it. Get treatment for your injuries because you want to minimize fallout and you may have an uninsured motorist claim if its deemed a hit and run and they can never pin it on him.
