Worcester, MA asked in Child Custody and Divorce for Massachusetts

Q: My son is living with his fiancé and her soon to be x-husband is going to court in RI for full custody because of this.

My son has been living with his girlfriend for a couple of months now. She (Mary) is presently going through a divorce and it should be final in a couple of months. Her ex-husband is taking her to court for full custody of her 5 yo son. He said it is because my son is living with her. Currently Mary and her ex have no custody agreement and her son has been living with her for the past 4 months. Currently his father sees him every other weekend. Does this dad have any chance in taking full custody of his son?
