Bradenton, FL asked in Family Law and Child Support for Florida

Q: Can FL better help enforce an arrears of $5,600+ than NC can? NC doesn't seem to care

NC won't take him to court unless he doesn't pay anything for 30 days even though he owes $5,671 arrears. NC doesn't seem to care as long as he pays something, which there have been months he's paid $40 of his supposed 507. Can Florida better enforce the arrears payments for NC? We have a house in both states so can use either state to enforce it. Meanwhile I am struggling to support my son when he doesn't pay, and he hasn't even seen him in 5 months for one reason or another, he always has an excuse. The only reason he saw him 5 months ago is because I took my son to his house, dropped him off, hung around that town, and picked him up the next day. Meanwhile he's buying 3 new autos and a new motorcycle. I am tired of us struggling because he knows how to work the system to stay under the radar. I have beenough dealing with this for 8 years now. We have a home in both states and if FL can help enforce his court order, I would love to move the case here. This is beyond out of hand now

A: If the person who owes this child support (your son's father, evidently) is in North Carolina, it is doubtful that Florida can do anything to enforce child support. If the obligor (your son's father) doesn't have any property in Florida (You indicated that you have a house here; I assume that home belongs to you, not the obligor), there presumably would be nothing the Florida courts or child support officials could seize and sell.
