Q: 11/12/12 Mom signs 1yr lease*Landlord files suit 10/27/15* I remained another year beyond my mother's lease...
They are suing my mother but she never was there a day, ever.
Here's the deal, I left florida for ohio in 2012, F.E.M.A. declared the place a disaster after a storm. My mom was in Ohio and signed the lease but never EVER was a tenant (she signed for me because when I arrived in Ohio I could not find enough money on the packed bus). I stayed in that building for 2 years (leaving sept. 9, 2014). Only I paid rent for the complete time. I filed a motion to the court for intervention in that I want them to take M E to court and not my elderly 70+ mother who isn't ... completely coherent. I have video and audio as well as written evidence that I'm the only tenant (I also have videos as the disasters in the ohio rental was occurring to show the damages are not anything of my doing! Videos of the water and ceiling tiles as they fell from the ceiling and drenched the carpets with me sounding sad inspecting all my damaged property. Can I get the L.L. to sue me instead?
A: Don't see why they would't --but maybe you need to get a lawyer to appear for your mom to file a motion for them for failiure to join an indispensable party. Real reason they want mom is they figure they may buffalo her into a settlement and if not she's good for the money and your arent'. But it's a bit technical so you should consult an attorney in the county where the court is and look for an attorney who represents tenants.
