Olive Branch, MS asked in Car Accidents and Criminal Law for Arkansas

Q: I have a relative in a situation. They were sitting on a none moving vehicle and a car struck them from behind.

A child bout 11 or 12 was sitting on the vehicle when it was struck. No relation just a neighbor i believe. The vehicle they were on wasn't moving but when they got hit they all flew off it. Now they are being charged with endangering the welfare of a minor. When it wasn't their fault. What does this mean

A: They need to get an attortney who handles criminial charges. A lot depends on where they wre. If they were not in traffic, and no one was behind the wheel maybe the cop just got it wrong. But at this point they need to 1)check and see if there was a camera if it was on the street or in a mall parking lot 2)get an anttorney to do the parking for them. Finally there's an issue of what their duty was.
