Q: Any recourse when someone's car insurance is minimum required and your injury is substantial?

A: Realisticallly no if you don't have "underinsured motorist coverage.". I assume you've talked to a member of the Fla. Trial Lawyers Assn/Assn for Justice--they give free consults.You should get a consult if you haven't had one as there may be other sources depending on if the person was doing a job for someone at the time, was served liqour by someone.

Your lawyer should ask for the other persons homeowners so you can see if there is an 'excess" policy.

A: Also, you may be able to recover a judgment; it doesn't depend upon what insurance coverage the other person had. But you will have to collect the judgment from the other person's assets and if that person doesn't have much in the way of such assets it may be, as a practical matter, not worth the effort. That is why, as Mr. Munsing suggests, you consult with an attorney.
