Q: I live in Virginia and would like to get 2 misdemeanor's expunged so I no longer have a record. How do I do this?
One offense happened in 2006 and the other in 2007.
A: Generally speaking, Virginia is harsh on crime. We do not allow expungments where there was a finding of guilt or facts sufficient to establish guilt. Your only option is a pardon from the Governor, and those are rare. Consider consulting with a local Criminal Law attorney.
A: Have an experienced local attorney look at the court documents if you unsure whether you enter a plea of guilty or facts were found sufficient for a finding of guilt. If it's that important to you, it's worth seeing if the Judge did not check all the correct boxes; in that case, an application for expungement can be brought in Circuit Court. Good luck.
