Fort Myers Beach, FL asked in Tax Law and Social Security for Florida

Q: I was recently awarded a Fully Favorable SSDI decision. I owe back taxes. Will this come out of lump sum?

I was on payment plan a few years back but defaulted. I called the Bureau of Fiscal Services/Treasury 800#, no offsets for my SSN. I figured out the back taxes/unfiled taxes to be approx $17K(minus penalties interest accrued). I would love to do a compromise to pay the taxes owed without the penalties/interest accrued(the $17k, as I have been looking into this option when lump sum hits). I want to resolve taxes I owe/just want to avoid the possible penalties and interest that estimate to be up to $30k total. A person told me they were successful-in in set up payment plan prior to lump sum. I've not called IRS directly yet to try set up payment plan/or do it online. I would like pay the $17K avoid the additional estimate $13K if possible. Anyway to find out if offsets will come out prior to contacting IRS? No levy documents sent to me that I am aware of-though I have moved numerous times with life's disabilities/events/struggles. No levy info on credit report. thanks!!

A: on plan vs lump best advice you will get is from a real CPA (NOT the "we have saved people from IRS debt" places that advertise).

A: Sorry didn't answer your question. Short answer is yes. https://www.ssa.gov/OP_Home/rulings/oasi/41/SSR79-04-oasi-41.html

They can but you can show hardship.Still be good to talk to the CPA of how to approach them without triggering something--but I gather they may know anyway. http://www.iowalegalaid.org/resource/what-to-do-when-the-irs-plans-to-take-your-so
