Q: What case exonerates TX. defend.for Failure to Yield ROW, at Stop sign resulting in collision? Defend. came to full stop
Pref. Right-of-way witness (w /o) stop sign crashed into defend. Defend followed rules of stop -- said cop in discovery video, but failed to yield. Doesnt prefen. Driver have to yield to car on right if they lawfully make it into intersection? Are there any precedents in Texas supporting defendant who exercised caution?
A: You need to talk to a texas attorney. Generally, a lot will depend on who hit who where. If you were all the way through and they rear end you maybe not. But understand they aren't a stealth car--they didn't come out of nowhere. You have a duty to be looking back over your shoulder as you turn in case someone comes into view so you can veer over to the curb. Chances are you thought you could make it and thought wrong.
